Girard man arrested on improper handling charge

LIBERTY — A Girard man is scheduled to appear in Girard Municipal Court Tuesday following his weekend arrest after police allegedly found him passed out in a running vehicle with a handgun.

Carl Kaplin, 66, faces charges of physical control of a vehicle while under the influence and improper handling of a firearm in a motor vehicle.

According to a police report, Liberty officers responded to an East Liberty Street residence just after 8 p.m. Saturday for a report of a suspicious vehicle, with the homeowner telling dispatchers that an unknown silver Ford F-150 was parked at the top of his driveway.

The report states officers found Kaplin asleep in the driver’s seat with the truck running and the doors locked. After reaching through an open window to unlock the door and turn off the ignition, police woke Kaplin, who appeared heavily disoriented, the report states, adding they could smell alcohol on him, and his eyes were bloodshot and glassy.

Police noted finding several empty plastic Fireball shot bottles scattered throughout the truck’s cab, and Kaplin said he was at a bar before meeting officers, but left because he was getting too intoxicated.

Kaplin said he pulled over in the driveway because he knew he shouldn’t have been on the road, according to the report.

The report states Kaplin refused to submit to a breath test and was unable to complete standard field sobriety tests despite agreeing to take one because of an inability to balance safely, officers noted, attempting to administer the horizontal gaze nystagmus test until the attempt was terminated.

During the encounter, Kaplin informed officers he had a weapon in the center console. Police recovered a 9mm Smith & Wesson Equalizer handgun from the console, alongside a pill bottle containing Oxycodone, which was prescribed to him.

Kaplin was released from jail the next day, jail records show.
