Jurors to hear closing arguments in rape trial

WARREN — Closing arguments are set to begin this morning in the sexual assault trial of Danny M. McFadden on the fourth day of proceedings in Trumbull County Common Pleas Court before Judge Cynthia Westcott Rice.

The state rested its case Wednesday after calling two witnesses, including a detective who detailed an hour-long interview with the defendant and a nurse practitioner who testified about a physical examination of the child at the center of the allegations.

Defense attorneys Joseph Ohlin and Edward J. Hartwig opted not to call McFadden to testify.

Proceedings are slated to resume at 9 a.m. today with closing arguments, followed by jury deliberations. McFadden, 76, faces charges that include rape and gross sexual imposition stemming from the allegations. He has pleaded not guilty.

Niles police detective Andrew Hacker, who led the investigation, told jurors he questioned McFadden shortly after the allegations surfaced in May. During the interview, portions of which were played in court, McFadden denied any wrongdoing and suggested the child involved had a history of fabricating stories. Niles Police Capt. John Marshall later joined the questioning, pressing McFadden on possible motivations for the claims.

Prosecutors also played a video of the forensic interview with the child, in which the accusations against McFadden were repeated. Hacker testified that McFadden voluntarily came to the station, waived his rights and participated in the recorded session, during which he described himself as an involved family member but insisted he was rarely alone with the child.

Nurse practitioner Amanda McAllen from Akron Children’s Hospital Mahoning Valley Child Advocacy Center spent about an hour on the stand. She described conducting a physical exam that revealed a vaginal infection consistent with, but not conclusive of, sexual assault.
