Former Warren prosecutor set for sentencing
A former city prosecutor from Warren is set to face sentencing Wednesday in a federal bribery case more than a year after he was indicted.
Nicholas Graham, who once worked as an assistant prosecutor for the city, pleaded guilty in August to one count of conspiracy. His sentencing is scheduled for 2 p.m. Wednesday in front of U.S. District Judge Solomon Oliver Jr. in Cleveland.
Graham’s lawyers included David J. Betras, Frank L. Cassese and Brian Patrick Kopp. On the government’s side were Assistant U.S. Attorneys Blake Jackson Ellison, James L. Morford and Elliot D. Morrison.
Just days earlier, on Friday, Graham’s co-defendant, Brian Votino, a business owner from Niles, was sentenced in the same case. Votino, who pleaded guilty in July to conspiracy, received three years of probation. The first 60 days were to be served on home detention with electronic monitoring, court records show.
The government dropped his other charges of wire fraud and extortion in exchange for his plea.
Assistant U.S. Attorney Elliot Morrison represented the government at Votino’s hearing, while Assistant Federal Public Defender Alvaro DeCola was with Votino.
The case stemmed from a scheme that investigators said happened between October 2019 and January 2020.
Graham and Votino were indicted in September 2024 on three counts: conspiracy to commit wire fraud, honest services wire fraud and Hobbs Act extortion under color of official right.
A federal grand jury in the Northern District of Ohio charged them after the indictment was unsealed.
