Appeals court upholds Warren man’s drug charges, sentence
WARREN — A Warren man lost his appeal Monday on cocaine possession and attempted tampering with evidence charges.
The Ohio 11th District Court of Appeals affirmed 50-year-old LC Deshawn Harvey’s conviction in a unanimous decision. The five-page decision was written by Judge Robert J. Patton, and supported by Judges Mary Jane Trapp and John J. Eklund.
Harvey was convicted in June by Trumbull County Common Pleas Judge Cynthia Rice and sentenced to 12-month concurrent prison term.
Harvey’s appeal, argued on his behalf by attorney Michael A. Partlow, raised an error in the trial court’s sentencing of Harvey to two terms of incarceration, stating that the record doesn’t support the sentence.
Instead, Partlow argued evidence from the trial court “clearly and concisely” indicated Harvey should have had community control sanctions imposed on him.
The appellate court disagreed with the assertion calling the ruling by Rice “consistent with the law,” further stating the trial court complied with “statutory requirements when imposing its sentence.”
Harvey is incarcerated in Marion Correctional Institution on a three-year prison term for another Trumbull County drug conviction.
