WARREN -- Ohio's 11th District Court of Appeals has upheld a Trumbull County Common Pleas judge's decision to deny a motion by a convicted Warren murderer to be allowed to request a new trial.
Three 11th District appeals judges upheld the decision Sept. 28 that Felix O. Brown Jr., 67, of Warren, could not file a motion for a new trial. Brown was sentenced to 18 years to life in prison in the February 1995 shooting death of his girlfriend, 26-year-old Monica Brandon, in a Niles apartment.
Brown lost other appeals and motions. including twice being refused by the Ohio Supreme Court, according to a Trumbull County Prosecutor's Office news release.
In February 2026, Brown sought permission from a Trumbull County Common Pleas Court judge to file a motion for a new trial based upon allegedly newly discovered evidence. In the appeal, Brown claimed the evidence could have been used to attack the credibility of or impeach the trial testimony of then Summit County Coroner Dr. William Cox, who performed the autopsy on Monica Brandon.
However, the local court rejected Brown's contention in March. In his appeal, Brown charged that the local court violated his right to due process under the Fifth, Sixth and 15th Amendments to the U.S. Constitution, but the appeals court disagreed.
Brown's next parole hearing is scheduled for December 2027, the release states.
