Grand jury refuses to indict northern Trumbull man on rape charge

By ED RUNYAN 7 min read

WARREN -- A Trumbull County grand jury on Wednesday refused to indict Andrew A. Miller, 41, of Park Avenue in Bloomfield Township, on a first-degree felony rape charge but did indict him on two low-level felonies of unlawful sexual conduct with a minor.

Miller was charged with the single count of rape Aug. 18, the same day he was arrested and taken to the Trumbull County jail.

The alleged victim told Trumbull County Sheriff's deputies Miller raped her multiple times over a few months when she was 14 or 15 years old in 2006. She said Miller was 21 years old.

She said when her parents found out, they reported it to Children's Services. "However, they never made a police report, as the Amish try to resolve things within their community, according to (the victim)," the report states. Miller spoke to deputies in July, saying the sex with the girl was consensual.

The two counts of unlawful sexual conduct with a minor allege that Miller engaged in sexual conduct with the girl when she was 15 in August of 2006 and knew the girl was less than 16 years old or was reckless in that regard. Miller appeared to be still in the Trumbull County jail on Wednesday afternoon.

Miller had a hearing in Newton Falls Municipal Court late last month that resulted in Miller's case being bound over to the grand jury. On the same day, two other northern Trumbull County men, Robert Detweiler, 26, and Rudy Detweiler, 22, of the same address on state Route 534 north of the Mesopotamia commons, were arraigned on one count each of first-degree felony rape and four counts each of low-level felony gross sexual imposition.

But their cases were only bound over to a Trumbull County grand jury Sept. 22, and the paperwork only reached the Trumbull County Courthouse Tuesday, so their cases were not heard by the grand jury yet. They also apparently remain in the Trumbull County jail, according to jail records.

The Detweilers were charged with the offenses Aug. 24, the same day they were arrested and taken to the Trumbull County jail. The Trumbull County Sheriff's Office was notified by Trumbull County Children's Services of allegations against the Detweilers and carried out an investigation.

$1.5 MILLION THEFT

Meanwhile, Kelly Dingman, 58, of West Main Street in Orwell was indicted Wednesday on aggravated theft, a first-degree felony, for a theft of at least $1.5 million from Leeda Northeast.

Leeda Northeast has an office on Parkman Road NW in Warren and provides residential, day services and other services to individuals with developmental disabilities, according to the Leeda Northeast web site.

According to Dingman's Linked-In Profile, she has worked more than 24 years as director of financial and accounting services for Leeda Northeast.

Warren police filed a felony theft charge against Dingman in Warren Municipal Court Aug. 10, and the charge was bound over to a county grand jury Aug. 18, according to court records. She was booked into the Trumbull County jail Aug. 10 and has remained there since then. Leeda Northeast of Parkman Road in Warren is listed as the victim of the offense.

When Ed Stark, superintendent of the Trumbull County Board of Developmental Disabilities, was asked about Dingman and the theft indictment, he said he does not know Dingman personally but he knows Leeda Northeast because Leeda Northeast provides services to clients of Trumbull DD.

He said Trumbull DD verified that the thefts did not have any impact on the funds of individuals receiving services and did not have anything to do with Medicaid billing or any funds of the Trumbull County Board of Developmental Disabilities.

He said Leeda Northeast is a provider of services to clients of Trumbull County DD, and "That is the business relationship we have. We authorize (Leeda Northeast) to provide services and bill Medicaid," he said.

Leeda Northeast "in some situations would have oversight of client funds for either Medicaid or Social Security," Stark said. "We have some oversight as far as those situations go. And we verified (the theft) had no impact on" Medicald, Social Security funds or Trumbull DD funds.

CRASH CHARGES

Also indicted Wednesday was Stanley A. Palmer II, 36, of Difford Drive in Niles on aggravated vehicular assault and drunken driving in an Aug. 7 single-vehicle motorcycle accident on Palmyra Road near Kibbler Toot Road in Warren Township.

An Ohio State Highway Patrol crash report states that crash was at 11:25 a.m. when Palmer drove off of the right side of the road into a ditch, struck a mail box and overturned, causing suspected serious injuries to Palmer and a 41-year-old Cortland woman who was his passenger. Both were taken to the hospital.

If Stanley were to be convicted of the aggravated vehicular assault, he could get several years in prison.
