WARREN -- Two counts of felonious assault and single counts of discharging a firearm into a habitation and failure to comply with an order or signal of a police officer against Kasey N. Morgan, 21, of Warren, were bound over to a Trumbull County grand jury Thursday in Warren Municipal Court.
Morgan appeared for a preliminary hearing before Judge Natasha Natale and waived his preliminary hearing, meaning he waived his right to have prosecutors present witnesses to establish probable cause that a crime was committed and that Morgan committed it.
Morgan appeared for the hearing in a county jail jumpsuit and walked with crutches. Natale ordered that Morgan remain held in the Trumbull County jail without bond.
Morgan, of Linda Drive NW, was shot during a 5:23 p.m. June 16 incident at Parkman Road and Northfield Avenue NW and was initially thought to be the victim in the case.
Jordan Coleman, 20, of Warren, and a woman, 18, of Niles, were initially charged with one count of felonious assault in the matter. But the charges against Coleman and the woman were dismissed a day or so later, according to court records.
Morgan was charged with the two counts of felonious assault and one count of discharging a firearm into a habitation June 29, according to court records. A Warren police detective said the reason for the dismissal of charges against Coleman and the woman and the three felonies charged against Morgan was that new evidence was obtained. No one else was shot in the June 16 incident, the detective said.
Morgan's failure to comply charge, also a felony, was filed Sept. 3 as a result of things that happened when Howland police arrested Morgan on warrants, Natale said during Morgan's hearing Thursday.
Assistant Warren Law Director Deena Tannert dismissed several low-level charges that were pending against Morgan Thursday, including driving under suspension, a stop sign violation and driving under suspension that were filed by Howland police Sept. 3.
On July 21, a felony charge of obstructing official business and a felony charge of improper handling firearms in a motor vehicle were filed against Coleman in Warren Municipal Court in relation to the shooting. The charges were bound over to a county grand jury July 28.
