Nursing home rape defendant found incompetent
WARREN — A Kinsman man charged with rape at a local nursing home was found incompetent to stand trial in Trumbull County Eastern District Court.
Kennis Haylett, 74, was declared unfit for trial by Judge Marty D. Nosich during a criminal status hearing via video Thursday. In March, Haylett did not enter a plea during a video arraignment in Trumbull County Eastern District Court after his initial arrest for sexual assault by Brookfield police.
He was accused of raping a woman on Feb. 16 at Windsor House at O’Brien Memorial Health Care Center in Masury.
Haylett was present in court via video with attorney John Falgiani, according to the court’s website. The victim’s advocate was present, but the victim’s spouse who had attended the previous court hearings was not present. The court added that there is not a substantial probability that Haylett’s competency can be restored within one year.
The prosecutor’s office will file an affidavit in probate court for civil commitment of Haylett. He will be housed at The Ridge, a Continuing Healthcare Solutions lockdown facility in Mineral Ridge, for 10 days, to give Trumbull County Probate Court officials an opportunity to consider civil commitment in the case.
