WARREN -- Among the 17 indictments handed up Thursday by the Trumbull County grand jury was one featuring Marcus D. Hemmingway, 27, of 549 Creed St. in Youngstown, who was indicted on three felony charges.
In the January 2024 term first-session report, Hemmingway had charges of burglary and resisting arrest dismissed. He was indicted on charges of aggravated burglary, felonious assault, escape and criminal damaging or endangering, a misdemeanor.
The incident that led to the recent charges against Hemmingway occurred on Nov. 14, 2023, according to Warren City Police Department records.
Hemmingway was arrested on charges of violation of a protection order, resisting arrest, criminal damaging and escape in November. Officers were dispatched to an apartment building at 1190 Robert Ave. for a criminal damaging incident. The caller told police that Hemmingway broke the windows on her vehicle, a Warren police report states.
The report states the officer met with a victim and witness near the end of the building's parking lot by the vehicle. "I could see a large cinder block laying on the front window that was shattered," the officer wrote.
Hemmingway and the witness were previously in a relationship and Hemmingway had a domestic violence incident earlier in the week that left the victim's jaw broken. Before leaving the Robert Avenue residence, dispatchers advised officers that Hemmingway had multiple warrants, some being felony, through Trumbull County Common Pleas Court.
Hemmingway was held at the point of a stun weapon when officers came into contact with him at his residence. He was then escorted to the street near a cruiser and searched.
When he was placed in the cruiser, Hemmingway told an officer that he was hot, so the officer turned down the heat, the report states.
"Hemmingway remained silent during the transportation after that," the report states. "When I turned southbound onto North Park Avenue, from Atlantic Street, I could hear wind coming into the rear cabin of the cruiser. Shortly after, I saw on my gauge cluster that a door had been opened. "
Hemmingway, then said something along the lines of "the door was open," the officer wrote. "I immediately activated my rear lights and came to a stop southbound past Wellington Funeral Home at 717 North Park Ave. I exited my cruiser to the other side in an attempt to shut the door. As I approached the passenger side of the cruiser, Hemmingway fled from the cruiser stating something along the lines of 'I'm out,'" the report states.
The officer pursued Hemmingway on foot and noticed that he slipped his right wrist out of the handcuff. The officer said Hemmingway ran west on Belmont Street behind the funeral home.
Eventually, Hemmingway gave up, the officer said, and was placed back in handcuffs. He was transported to the Trumbull County jail without further incident.
The stun weapon cartridge was collected and placed into evidence.
The following felony cases will be arraigned within the next two weeks. Named are:

• Melissa A. Mack, 36, Larchmont Avenue NE, Warren, aggravated possession of drugs.
• Michael Crow, 32, Larry Lane, Cortland, aggravated possession of drugs, illegal use or possession of drug paraphernalia.
• James A. Jr. Washington, 30, Martin Drive, Warren, aggravated possession of drugs.
• Devonte J. Atwater, 24, Hiram Street, Warren, two counts of receiving stolen property.
• William Johnson, 56, Tod Avenue NW, Warren, receiving stolen property.
• John W. Huzvar, 52, Trumbull Avenue, Girard, possession of cocaine.
• Robert C. Duke, 54, U.S. Route 322, Windsor, tampering with evidence.
• Willie L. Waller, Jr., 27, Patricia Drive, Girard, vandalism.
• Henry Benton Cain, 42, Forest Street NW, Warren, domestic violence.
The following misdemeanor cases were remanded to a lower court:
• John C. McLane, Jr., 24, High Street NE, Warren, operating a motor vehicle while under the influence of alcohol or drugs.
• Heath N. Cline, 34, North Dunlap Avenue, Youngstown, attempted possession of heroin, attempted possession of fentanyl-related compound, possession of drug abuse instruments and two counts of illegal use or possession of drug paraphernalia.
The grand jury no billed (no indictment) the following cases:
• Joshua M. Braithwaite, 38, Eagle Creek Road, Leavittsburg, possession of drugs.
• James D. Williams, 34, Haymaker Street, Youngstown, possession of drugs.
• Rice, reckless homicide.
• McLane, improperly handling firearms in a motor vehicle and failure to comply with order or signal of police officer.
• Atwater, receiving stolen property.
• Cline, two counts possession of drugs.
• Cain, felonious assault.
