WARREN -- A 23-year-old Liberty Township man accused of shooting his then girlfriend while intoxicated on the Fourth of July was sentenced Thursday to 24 months by common pleas Judge Ronald Rice.

Isaiah Garcia, of Ohio Trail, pleaded guilty Oct. 5 to an amended indictment of attempted felonious assault, a third-degree felony, and misdemeanor charges of using weapons under the influence and domestic violence, in the wake of the shooting in the 3400 block of Ohio Trail.

Garcia initially was indicted on charges of felonious assault, improper discharge of a firearm, using weapons under the influence, domestic violence and assault for the nonfatal shooting.

About 1:30 p.m. July 4, police responded to the area and found the 23-year-old woman in the living room with a gunshot wound to the chest, a police report states.

She was transported by the Liberty Fire Department to St. Elizabeth Youngstown Hospital and survived the shooting.

Prosecutors say Garcia was handling the gun when it went off and wounded the woman. She did not appear in court Thursday but submitted a victim's impact statement and was aware of the plea agreement.

Rice noted that Garcia has a history of pointing guns at the victim in the case, as was noted by the victim in her statement to the court.

"He was stupid and he's gonna pay for that," Rice told defense attorney Heather Ninni, who asked for probation in the case.

"You put a gun in your hand, point it at someone and pull the trigger -- that's not an accident -- that's an intentional act; shame on you," Rice said.
