NEWTON FALLS -- A 20-year-old Newton Falls man was arrested just four hours after he's accused of posting a photo on his Instagram story depicting himself holding a rifle on the rooftop of a local bar.
Shayne Battison was arrested by Trumbull County sheriff’s deputies, with assistance from Ohio State Highway Patrol troopers, at his apartment about 4:20 p.m. Wednesday.
In the photo, according to a caller who tipped off Trumbull County 911 dispatch, Battison was armed with a rifle as he was crouched over the roof of Faces Lounge overlooking West Broad Street, where Battison lives in an apartment above the bar.
The witness to the photo spoke to officers and showed them the photo. In the report it was noted he sounded "visibly upset" and his hands shaking as he expressed concern for the safety of his family.
When police arrived at Faces Lounge they spoke to an employee who offered to call Battison down to the door. The report states that once Battison was downstairs he was placed under arrest and read his Miranda rights by officers.
According to the police report, residents in the surrounding area expressed concerns that an active shooter situation was unfolding -- with one resident asking if it was safe to take his daughter to dance class over rumors he heard of a potential shooting in progress.
A local business owner also spoke to police over concerns of whether to shut down his business for the safety of citizens.
There was a reported call from another business owner who also heard the active shooter rumor and called to ask if it was safe to keep bingo open.
Speaking to officers, Battison admitted to owning a rifle in his apartment, the report states.
He also said the rifle is not stolen and he legally is allowed to own the weapon.
The report states that police conducted a criminal history report on Battison that turned up felony charges for aggravated robbery and kidnapping when he was a juvenile -- and these would prohibit Battison from owning weapons.
Of those two charges, one was held while the other was adjudicated -- the report didn't specify which charge.
Battison was transported to the Trumbull County jail.
He faces charges of inducing panic and having weapons under disability.
