WARREN -- The attorney for a man facing capital murder charges in connection to a deadly shooting last summer on West Market Street, near a popular restaurant, asked that a hearing be delayed.
Morgan Caruso, who is representing Dominic Harvey of Champion, told Trumbull County Common Pleas Judge Cynthia Rice on Wednesday she needed time to examine evidence presented to her by prosecutors.
Rice rescheduled the hearing for April 5. A jury trial is scheduled to begin Aug. 21.
Harvey, 21, of Hillsdale Drive NW, is charged with aggravated murder with a specification of aggravating circumstances and firearm specifications, attempted aggravated murder with firearm specifications, tampering with evidence and receiving stolen property. He continues to be held in Trumbull County jail without bond.
The aggravating circumstances, according to Assistant Prosecutor Christopher Becker, involve Harvey being accused of a course of conduct that resulted in the death, or attempt to kill two or more people; and these circumstances allow for a possible death-penalty level punishment if Harvey is convicted.
Harvey was arrested hours after the July 21. 2022, shooting on West Market Street that killed Jauton Lee, 23, and wounded a 24-year-old man. Warren detectives lauded the help of eyewitness reports and other public input in solving the case. The incident took place near a dinner crowd dining inside the Hot Dog Shoppe.
