Mecca couple sues Allstate after 2018 vehicle crash

Insurance company accused of not honoring uninsured claim

WARREN -- A Mecca couple involved in a Bazetta crash in late 2018 are suing their insurance company for not honoring an uninsured motorist claim.

Amy and Michael Haskett of 4005 Greenville Road have initiated a civil action against Allstate Fire and Casualty of Northbrook, Ill. The case, which was filed this week in Trumbull County Common Pleas Court, was assigned to Judge W. Wyatt McKay.

According to the lawsuit, a car driven on Dec. 21, 2018, by Joshua L. Holmes went left of center, striking the Haskett's southbound vehicle, causing it to go off state Route 5 into a ditch.

The lawsuit identified Holmes as an unlicensed and uninsured driver who was deemed negligent in the police report.

According to the lawsuit, the Hasketts incurred almost $18,000 in medical expenses.

The lawsuit reported that Holmes died March 1, 2019. According to Ohio State Highway Patrol reports, Holmes, 39, of Farmdale, was identified as the pedestrian who was struck by a semi tractor-trailer crossing the same Route 5 in Bazetta.

Because Holmes left no estate, the lawsuit states the Hasketts put in an uninsured / underinsured claim with Allstate.

An exhibit of the legal action showed that the Hasketts were insured $25,000 per person / $50,000 per person for uninsured motorist coverage plus a medical pay of $1,000 per person.

The lawsuit states Allstate refuses to pay the Hasketts on this claim.

The plaintiffs, who are represented by attorney Charles Dunlap, demand the judge to find Allstate in breach of contract and award them $50,000 plus costs and interest from the date of the accident.

An attempt to reach legal counsel for Allstate through its email system was unsuccessful.
