Man indicted for second time in two weeks

Drugs found in car sickened officer

WARREN — A city man already under indictment on numerous charges stemming from a November domestic incident was indicted again Thursday on drug charges stemming from a traffic stop less than a month later.

Juchard Duncan, 29, 2275 Northwest Blvd., Warren, was indicted by a Trumbull County grand jury on charges of trafficking in a fentanyl-related compound, possession of a fentanyl-related compound, trafficking in heroin and possession of heroin, all with a forfeiture specification.

During a traffic stop Dec. 5, Howland police officer Adam Rios reported feeling weak, cold and light-headed, as well as having a tingling sensation after he pulled a plastic bag with white powder out of Duncan’s right pocket, according to a police report. The powder was tested at a laboratory and came back positive for heroin and fentanyl, according to the indictment.

In addition to the suspected drugs, police investigators confiscated $9,121 in cash found on Duncan and within the car. The money found included 50 $100 bills, 60 $50 bills, 56 $20 bills and one $1 bill, the report states.

Rios made the initial stop when he noticed a gray Chevrolet Impala traveling south on Elm Road. A check of the license plate found the vehicle’s owner, Bralia Rodgers, had a suspended license.

When Rios drove behind the vehicle, Rodgers sped up, eventually running a red light at Genesee Avenue, the police report states. She stopped on Clermont Avenue.

Walking on the passenger’s side, Rios noticed a copious amount of money on the floor board. Duncan, according to the police report, appeared nervous and his hands were sweating. During the arrest, Duncan repeatedly told officers that he could not believe they were taking his money from him, the report states.

Duncan already was wanted for an incident that occurred the evening of Nov. 17, when he is accused of forcibly entering the home of two of his children’s mother with a handgun, pulling her wig off her head and punching her in the left side of her face. The woman yelled for her children to run out of the house, but only one, a 7-year-old, managed to get out and call police.

For that incident, Duncan was indicted March 5 on charges of domestic violence, two counts of aggravated burglary, having weapons while under disability and three counts of child endangering.

Duncan is free on bond and is due in Trumbull County Common Pleas Court for a hearing in both cases April 1, but that could change as the court adjusts its schedule because of the COVID-19 outbreak.

Twenty-four others were indicted by the grand jury on Thursday, including:

• Jerry O. Smiley, 43, Warren Correctional Institution, harassment with a bodily substance (direct presentment);

• James R. Shaver III, 36, 8829 state Route 88, North Bloomfield, escape (direct presentment);

• Keith J. Kirkland, 29, Southern Ohio Correctional Institution, illegal conveyance of prohibited items onto the grounds of a detention facility or institution (direct presentment);

• Kaylee M. Conde, 20, 3685 state Route 305, felonious assault;

• Joseph B. Harris, 35, 441 Lora Ave., Youngstown, possession of drugs and illegal use or possession of drug paraphernalia;

• Simonna S. C. Hill, 30, 105 South Portland Ave., Youngstown, trafficking in drugs, possession of heroin, possession of a fentanyl-related compound, all with forfeiture specifications, illegal use of supplemental nutrition or WIC program benefits and improperly handling firearms in a motor vehicle;

• Allante Jones, 23, 1180 Roberts Ave. NW, Warren, tampering with evidence;

• Gabriel Artis, 56, 726 Second St. SW, Warren, two counts of OVI with forfeiture specification;

• Keiry J. Patterson, 26, 2346 Wick St., Warren, having weapons while under disability, aggravated possession of drugs with forfeiture specification and carrying a concealed weapon;

• James D. Spitler, 21, 3438 Hoagland Blackstub Road, Cortland, receiving stolen property;

• David M. Conley, 37, 6410 Shafer Road, Warren, possession of a fentanyl-related compound and possession of heroin;

• Paige Vince, 21, 1111 Woodbine Ave., SE, Warren, possession of a fentanyl-related compound;

• Linsey M. Bosley, 34, 467 York Ave., Warren, possession of cocaine;

• Tara L. Garland, 35, 5990 West Webb Road, Mineral Ridge, three counts aggravated possession of drugs;

• Aeriel L. Fuller, 26, 331 Grant St., Niles, two counts endangering children;

• Chad S. Georgia, 37, 586 Trebisky Road, Cleveland, aggravated possession of drugs;

• Anthony B. Durso, 29, 212 S. Cedar Ave., Niles, aggravated possession of drugs;

• Eric J. Kenney, 22, 411 N. Saint Clair St., Girard, having weapons while under disability, two counts OVI, possession of cocaine and aggravated possession of drugs;

• Robert J. Travis Jr., 44, 1148 Cedar St., Newton Falls, possession of cocaine;

• Ronald R. Dines, 39, 5308 Copeland Ave. NW, Warren, possession of a fentanyl-related compound and illegal use or possession of drug paraphernalia;

• Tristian J. Wadenah-Sehlstro, 24, 746 State Road NW, Warren, aggravated possession of drugs;

• David A. McLaughlin, 28, 1 Louise Lane, Girard, possession of fentanyl-related compound; and

• Jeremy D. McMahan, 41, 143 St. John St., Niles, theft from a person in a protected class.

The grand jury did not indict the following:

• Ryan L. Howard, 31, 4611 Market St., Youngstown, receiving stolen property, possession of drugs and carrying a concealed weapon;

• Patrick M. Jordan, 37, 1075 Tait Road, Warren, breaking and entering;

• David N. Hollie Sr., 40, 204 Atlantic St., Warren, aggravated burglary and assault;

• Harris, receiving stolen property;

• Jones, discharging firearms on school premises.

• Fuller, domestic violence.
