Cortland woman arrested on OVI charge in Liberty
LIBERTY — A Cortland woman is set to appear in Girard Municipal Court today after police said she nodded off and struck a dump truck Friday afternoon on Belmont Avenue.
Jennifer England, 34, is facing an OVI charge, as well as charges for lanes of travel and drug paraphernalia.
According to the Liberty police report, officers were called to the 6400 block of Belmont Avenue in response to a crash involving a car and dump truck. England, who was driving a Cadillac XTS, told officers she was not hurt and didn’t need medical attention.
The officer noted she was heavily slurring her speech, her eyes were glossy and she had difficulty maintaining balance, according to the report. She also told officers that she had just gotten the Cadillac and struggled to drive it because of a lack of familiarity.
When asked about the crash, England told officers she looked down at her phone for a second and was unsure what happened. Because of her actions being sluggish and difficulty staying awake, officers believed she was under the influence of narcotics.
Upon completion of the crash investigation, it was determined England was driving the Cadillac northbound on Belmont and crossed several lanes of southbound traffic before striking a dump truck and coming to rest on the road’s shoulder, the report states.
Officers administered a series of field sobriety tests to England, who denied any drug usage before the crash. The officer reported she started too soon, failed to touch her heel to toe, used her arms to balance and stopped to regain balance, as well as stopped to remember to turn and take nine steps back during the walk and turn test.
The report states that because of the indicators during that and two other tests, there was probable cause to arrest England for OVI. The report also states she refused to submit to any chemical test, telling officers to get out of her face, and the charge would be dismissed because she had family in Trumbull County law enforcement.
Prior to taking her to Trumbull County jail, officers found a plastic pen cartridge that contained a white residue, which was taken as evidence that resulted in the drug paraphernalia charge. While en route to jail, she told the officer that she was clean for a decade before resuming fentanyl use two weeks ago, the report states.
England told officers she met an unknown person in Youngstown and picked up a mixture of something, before snorting it and attempting to return to Cortland. She did not know what the mixture was, but believed it to be fentanyl, she told officers.
