Trial for theft at Macy’s begins for Niles man

WARREN — Jody A. Elliott, 43, of Victor Avenue in Niles, went on trial Tuesday in a Feb. 13, 2019, robbery involving the Macy’s store in the Eastwood Mall.

Elliott is charged with felony robbery and could get several years in prison if convicted. A jury was seated Tuesday morning in the courtroom of Judge Peter Kontos of the Trumbull County Common Pleas Court. The trial resumes today.

He is accused of trying to steal $3,200 worth of Polo clothing.

Niles police were called to the store 1:15 p.m. Feb. 13, 2019, as loss-prevention officers were fighting with Elliott in the front of the store. When an officer arrived, the loss-prevention officers still were struggling to maintain control of Elliott on the floor.

The officer had Elliott stand up and saw that Elliott had some blood on the side of his head. Ambulance personnel evaluated Elliott’s cut, but Elliott also complained of pain in his neck and was taken to St. Joseph Warren Hospital and later to the Trumbull County jail.

The loss-prevention officers said Elliott was trying to steal several items of clothing. When they confronted him, he began to fight with them.

The struggle resulted in several racks of clothing and other merchandise being knocked over and scattered and broken on the floor.

Elliott had an address on Penn Avenue NE in Warren at the time.
