Dayton business wants decision on sign reversed
WARREN — A Dayton area business filed an appeal to a Dec. 10, 2021, decision by the Hubbard Township Zoning Board of Appeals that denied a variance for the company to put an advertising sign in front of its storage garages in the 6000 block of West Liberty Street.
The notice was filed Jan. 5 by an attorney for Summit Locations LLC of Congress Park Drive, Dayton. A hearing has yet to be scheduled by Trumbull County Common Pleas Judge Andrew D. Logan.
Robert M. Ernst, a Cincinnati attorney representing Summit Locations, said the decision made by the board was “unreasonable, unlawful and unsupported by a preponderance of evidence on the record,” and is contrary to the public interest.
Township zoning officials voted to deny the sign because of its location.
The filing also claims the resolution is invalid and violated state and federal law, but the filing did not say why.
Named as co-defendants in the appeal are the township board, the township as a whole and its zoning inspector, Denny Parsons. Parsons has not responded to an email sent Monday, a federal holiday, asking for an explanation about the sign variance being denied.
