Liberty condo lawsuit settled out of court

WARREN — A Liberty condominium group of 41 lot owners within the Kline’s Farm development has dropped its lawsuit against the community development group, its real estate agency and others, alleging violation of community rules.

The recent Trumbull County Common Pleas Court docket entries for the lawsuit filed in early 2021 against Kline’s Farm Community Inc., Altobelli Real Estate, Home and Land Developers, Kline’s Farm Master Association and BrodMor Inc. property management group show that the parties came to an out-of-court settlement. Details of the terms are not in the court record.

A entry signed by visiting Judge Gary Yost on July 14 shows the matter was settled and the lawsuit dismissed with prejudice, with the court maintaining jurisdiction ensuring that the settlement agreement will be followed.

The owner of Altobelli Real Estate, Jason Altobelli, confirmed earlier that the lawsuit was settled saying the issue involved difficulties with one individual in the condo group.

Among the allegations of the condo owners, according the lawsuit, the developers have permitted the display of unsightly advertising signs at the entrances to Kline’s Farm on Tibbetts Wick Road and Belmont Avenue and failed to enforce landscape requirements.
