Falcon lawsuit amended

Now includes company owner, CounterPoint Capital Partners

WARREN — The federal class action complaint against Falcon Transport Inc. filed Monday was amended Thursday to add the private equity firm that owned the company as another defendant.

The suit, filed by ex-Falcon employee Mary Chavez of Girard, now lists Los Angeles-based private equity firm CounterPoint Capital Partners LLC, which bought the defunct trucking company in September 2017.

Officials from CounterPoint could not be reached for comment. The company has a website, but it’s been removed of all information.

The lawsuit by Chavez, who worked in the office, claims Falcon and CounterPoint violated the federal Worker Adjustment and Retraining Notification (WARN) Act’s requirement of giving their employees at least 60 days advance written notice of termination.

The act, approved by Congress in 1988, provides employees who claim they were not property notified of the mass layoff the ability to seek back pay and benefits for up to 60 days.

It was put into place to give workers sufficient time to find other work or retraining before losing their jobs.

It seeks 60 days of wages and other benefits.

The trucking company, which was headquartered on Belmont Avenue in Liberty, on Saturday suddenly closed, telling the employees, some of whom were truck drivers on the road, the news via email.

The company had not filed a WARN notice with the Ohio Department of Job and Family Services as of late Thursday afternoon, according to the office’s website. It did file WARN paperwork with the Tennessee Department of Labor and Workforce Development of the closure of a facility in La Vergne, Tenn., that affected 70 employees.
