Wed. 2:04pm: Man innocent of felonious assault

YOUNGSTOWN - Jurors today in the courtroom of Mahoning County Common Pleas Court Judge John Durkin found a man charged with assaulting a Poland Village police officer on Aug. 2, 2011 innocent of felonious assault.

Marcus Thomas, 33, of Manley Avenue, was charged with felonious assault on a police officer, and fleeing and eluding. Prosecutors say Thomas knocked over an officer with a car he was driving while fleeing from a drive where he had parked and ran through a lawn.

Jurors heard closing arguments before Durkin instructed them on the law just before lunch, then they came back with their verdicts. He was found guilty of fleeing and eluding.

A spokeswoman for the judge said because he was found innocent of the felonious assault charge the fleeing charge was reduced to a misdemeanor. He was sentenced to time served.
