Wed. 1:39pm: Old civil case settled

YOUNGSTOWN - An almost 12-year-old civil case against former Mahoning County Sheriff's Office Maj. Mike Budd and former Sheriff Randall Wellington was settled Tuesday.

A common pleas court spokeswoman said the suit, which was to be heard by Visiting Judge Thomas Curran, was settled but terms of the settlement are not yet available because the lawyers are still working on the wording.

Budd, who served a federal prison term after being found guilty of violating prisoners' civil rights in the county jail, and Wellington were being sued by former Deputy John Martyszyn for false arrest and civil rights violations.

Martyszyn claimed his rights were violated when Budd had him arrested on a bad check charge after some work he did for the mother of another deputy was halted. The charge was later thrown out of Youngstown Municipal Court.
