Attorney general wants stay of execution lifted

WARREN - The Ohio attorney general has filed a motion with the U.S. Sixth Circuit Court of Appeals that seeks to lift a stay on the Dec. 8 execution of local death row inmate Kenneth Biros.

The motion filed Tuesday states that Gov. Ted Strickland already has the power and has in fact delayed other executions until Ohio develops a suitable protocol for executions by lethal injection. And an assistant attorney general also points out that Biros' attorneys have never made any claim that they are ''likely to succeed on the merits'' of their case - required criteria for a preliminary injunction.

Trumbull County Prosecutor Dennis Watkins has remained confident that Biros can be executed on time despite the stay earlier this month.

Watkins attended a proceeding last week that allowed him to view Biros' latest claims in preparation for a Nov. 9 clemency hearing in Columbus.

Biros was convicted in the Feb. 7, 1991, slaying and dismemberment of Tami Engstrom, 22, of Brookfield, after he offered to drive her home from a bar.

Biros, 51, came close to being executed in 2007, when the U.S. Supreme Court ruled that the execution should be stayed to allow Biros to present initial lethal injection arguments to a panel of federal judges. Since it has been two years, the state requires another clemency hearing to consider any new evidence.

Engstrom's family had traveled to Lucasville to witness Biros' scheduled execution at that point, only to learn that Biros was getting more time to argue against the penalty.

The stay that Attorney General Richard Cordray wants to eliminate came after the Sept. 15 botched execution of death row inmate Romel Broom, which was also delayed by a federal judge until a back-up or alternative method of lethal injection could be designed.

Strickland has postponed until the spring the executions of two other men who were scheduled to die before Biros, Lawrence R. Reynolds Jr. and Darryl Durr. The state is considering ways to adjust its death chamber procedure after technicians couldn't locate suitable veins on Broom through which to administer lethal drugs.

''The constitution shouldn't protect him (Biros) from some pain,'' Watkins said.

to take someone's life I ment to say of course. Anyway, you would not have to embarrass yourself with botched executions this way either.

why don't you abolish the death penalty and that is the way to save money. In case you did not know this. And also there is no human who has the right to kill someone's life. And A life for a life that was in Middle age.

I'm curious to know who started the whole "prisoners rights" movement and what idiot in our judicial system thought it was a good idea? WTF makes any sane person think that a man who commited a crime like this deserves compassion when he showed no compassion the night he took a life? Our judicial system has no balls any more. Bring back they days when you went straight from the guilty verdict to the noose. Instead we make them comfy give them 3 squares, cable tv, a home gym to work out on. He should be thankful all he'll feel before he is executed is a little needle stick.

BOOHOO,,WAH WAH,please don't put me thru any pain!I,m just a big muscular guy who chipchopped a teeny little woman to death then scattered her all over 2 counties.. be gentle with me.THIS GUY IS UNBELIEVABLE!!!I,m just as sick of his whining as everybody else is or should be by now. MAN-UP you creep.Let Mr.Watkins put us all out of misery and get this over and done with so our tax money can go to something constructive,this jerk has sucked up more than his share.

Myself im sick of how much time & money is wasted on these murder's BIROS, DANNY LEE Hill need To Feel the pain of it all. Id love my chance at both of them. Shoot one knee off, at a time, then both hips, both arms, Watch them scream like there victims, last shot between there eyes. These So called Humans didnt care or have remorse for there victims. Just think how much money would be saved getting rid of these low lifes. Free the world of there kind. To protect myself Id kill someone but to go out and kill an innocent person NO WAY. And these killers dont care there fed and housed or get out in 7-25 yrs to do it again, PLEA bargains should never be allowed for a killer, non stay of exacution. Its not fair to the families, and especially to there victims. He gets to live why im cold in my grave away from my family who loves me. Im tired of hearing humane or rights for these killers, What happen to the rights for there victims. THEY are getting Zero rights. KILL THEM.
