That's easy Daniel. Look up the law. Premeditation alone is not enough for the death penalty in Ohio. There has to be aggravated murder plus a listed specification in the charge. Those specifications are very...specific and evidently not present in this case.

Good question Daniel. One would hope that this type of person never leaves a penal institution again. He is one those that is a danger to society.
