TJX court hearing today
WARREN — A hearing on a permanent injunction in the case challenging state legislation that fast-forwarded a referendum on zoning changes for the proposed TJX HomeGoods distribution center is set for 10 a.m. today in Trumbull County Common Pleas Court.
Opponents argue sections of the bill that moved the vote to August from November is unconstitutional because it broke the state’s one-subject rule by adding the election language as a rider to a bill that did not have anything to do with the zoning changes, and the state’s uniformity rule because the action mandated in the bill applies only to the unique situation the village is in.
A request for a temporary restraining order in the case has already been rejected.
The referendum was overwhelming dismissed by voters Aug. 21 by an average of 76 percent in favor of making the zoning change from residential to industrial.
