Man accused of raping woman with mental disability

WARREN — A Niles man accused of raping a woman with a diminished mental capacity was arraigned Wednesday in Trumbull County Common Pleas Court.

Donald “Shorty” Painter, 63, of Nash Avenue, faces six counts of rape and is accused of raping the woman between August and October 2017, according to an indictment.

The victim’s legal guardian told police the victim has the mind of an 11-year-old, according to a police report.

The victim was left with the guardian’s sister in Niles when the guardian and her husband went on a trip to Florida. Painter, who co-habitates with the guardian’s sister, is accused of asking the victim to come into his basement “mancave” to show her something where he then ordered her to disrobe and sexually assaulted her, the report states.

The victim has had an intellectual developmental disorder since birth, has an IQ ranging from 50-56 and is ineffective in independently managing her life, according to a psychological report filed with the court.

The victim is at risk of being manipulated and doesn’t have the ability or emotional maturity to consent to a sexual relationship, the psychological report states.
